01Acceptance of Terms
These Terms of Service (the “Terms”) govern the access to and use of the services offered by [Ragione Sociale GarageBooks S.r.l.] through the website garagebooks.ai (the “GarageBooks”, the “Platform”, or the “Service”).
By registering or using the Service, you confirm that you have read, understood, and fully accepted these Terms, as well as GarageBooks’s Privacy Policy. If you do not wish to accept them, please do not use the Service.
These Terms constitute a legally binding agreement between you (the “User”) and [Ragione Sociale GarageBooks S.r.l.].
02Definitions
- User: the natural person who registers on the Platform for personal, non-commercial use, unless otherwise specified in the subscription tier.
- Seller: the User who lists one or more books for sale through the Platform’s marketplace. May be a consumer or someone acting in the exercise of a professional activity (Dealer).
- Buyer: the User who purchases one or more books through the Platform’s marketplace.
- Content: any text, image, audio, video, data, or material uploaded, published, transmitted, or otherwise made available through the Service.
- AI Credits: usage units for AI features (cover recognition, price research). They come in two forms: monthly credits (renewed with the subscription) and one-time purchased credits (permanent, do not expire).
- Tier: subscription level (Free, Collector, Dealer) with related features and credit allowances.
03Account registration
To use the Service’s features, you must create an account by providing a valid email address and a secure password, or by authenticating via Google.
You represent and warrant that:
- you are at least 16 years old;
- the information you provide is true, accurate, current, and complete, and that you will keep it so;
- you are solely responsible for the activities carried out through your account;
- you will keep your access credentials with the utmost care and notify us promptly of any unauthorized use.
GarageBooks may suspend or terminate the account in case of inaccurate information or violation of these Terms.
04Service description
GarageBooks is an online platform for collectors of automotive books. The Service includes, among others, the following features:
- Collection management: cataloging of one’s books, detailed records, search, filters, statistics.
- AI features: cover recognition, ISBN scanning, price estimation and research.
- Marketplace: posting sale listings, searching listings, offers, buyer–seller messaging, orders, reviews.
- Public profiles: collector showcase, SEO indexing, privacy options.
- Premium services: Collector and Dealer subscriptions, additional AI credits, listing boosts.
GarageBooks reserves the right to modify, suspend, or discontinue, at any time and in whole or in part, the Service or individual features, giving Users reasonable advance notice, except in cases of force majeure or of technical/security urgency.
05GarageBooks’s role in the marketplace
In the marketplace, GarageBooks acts as an online intermediary service provider under Regulation (EU) 2019/1150 and the Digital Services Act (Regulation (EU) 2022/2065). GarageBooks is not a party to the sale contracts entered into between Buyers and Sellers: such contracts are formed exclusively between the parties.
GarageBooks does not own or hold the books listed for sale; it does not guarantee the authenticity, conformity, condition, or accuracy of the listing descriptions; and it does not directly intervene in the physical delivery of goods.
GarageBooks provides the tools to facilitate the matching of supply and demand, communication, payments (via Stripe Connect), order management, and a system of reviews and reports.
06Subscriptions, AI credits, and billing
Tiers and pricing
The Platform is available in three tiers: Free, Collector, and Dealer. Prices, included features, and AI credit allowances are listed on the /pricing page and are an integral part of these Terms.
Payment and renewal
Subscriptions are monthly and renew automatically at expiry until cancelled. Payments are handled by Stripe Inc. using accepted methods (credit/debit cards, supported wallets). GarageBooks does not store card data.
Cancellation and right of withdrawal
You can cancel your subscription at any time from the “Account” section of your profile. The cancellation becomes effective at the end of the current billing period: you will continue to have access to the tier until the subscription expires.
Pursuant to Article 59 of the Italian Consumer Code (Legislative Decree 206/2005), the 14-day right of withdrawal does not apply to digital content whose performance has begun with the User’s express consent and acknowledgement of the loss of the right of withdrawal. By accepting these Terms, you accept that the Service’s performance starts immediately.
AI credits
Monthly AI credits are restored at each subscription renewal and do not carry over between subsequent months. One-time AI credits purchased via bundles are permanent and do not expire. Credits already consumed are not refundable.
Price changes
Any subscription price changes will be communicated by email at least 30 days before they take effect and will apply to the next billing cycle. You may cancel before the change takes effect to avoid it.
Invoicing and VAT
GarageBooks issues electronic receipts or invoices via Stripe Tax, with automatic VAT application according to the User’s country rates. For requests regarding invoice details or VAT ID, a dedicated section is available at checkout or in the Stripe Customer Portal.
07P2P marketplace, platform fee, and Stripe Connect
Seller onboarding
To receive payments through the Platform, the Seller must complete Stripe Connect onboarding (Express account), providing identification data (KYC), an IBAN account, and any additional data required for anti-money-laundering obligations (AML/KYC).
Payment flow
The Buyer pays the full amount (book price + shipping costs + any platform fee) via Stripe. The amount is held in escrow on Stripe until:
- the Seller provides a valid tracking number;
- the order is marked as delivered;
- the period within which the Buyer can open a dispute has elapsed.
Upon meeting these conditions, the payout is transferred to the Seller net of the platform fee and Stripe fees.
Platform fee
GarageBooks retains a commission equal to 5% of the sale amount (excluding shipping and taxes), as compensation for the intermediation and protection service. The fee is transparently shown at checkout. Any changes will be communicated with at least 30 days’ notice.
Shipping and tracking
The Seller must ship the book within 5 business days of order acceptance, using a carrier that allows tracking, and must enter the tracking number into the Platform. Failure to comply authorizes GarageBooks to cancel the order and refund the Buyer.
Disputes
The Buyer may open a dispute within 7 days of delivery in case of: non-receipt, product significantly different from description, or visible damage upon receipt. The procedure is described in the “Orders” section of the Platform. GarageBooks may intervene as mediator and, if the complaint is deemed well-founded, authorize a full or partial refund via Stripe.
Consumer right of withdrawal
Where the Seller acts as a professional vis-à-vis a consumer, the Buyer has the right of withdrawal within 14 days of delivery pursuant to Article 52 of the Italian Consumer Code. Return shipping costs are borne by the Buyer, unless otherwise stated by the Seller.
08User obligations and prohibited content
By using the Service, you agree not to:
- violate laws, regulations, or rights of third parties (including intellectual property and personality rights);
- publish false, misleading, offensive, defamatory, obscene, discriminatory content, or content inciting hatred or violence;
- list for sale counterfeit, illegal, stolen, or goods you do not legitimately own;
- attempt to circumvent the Platform’s payment system (e.g., directing the Buyer to off-platform payments to avoid the fee);
- send unwanted communications, spam, or unsolicited promotional messages to other Users;
- collect information about other Users without their consent, or use bots, scrapers, or automated techniques;
- attempt to compromise the security, availability, or integrity of the Service;
- duplicate, copy, sell, or commercially exploit any part of the Service without GarageBooks’s written authorization;
- impersonate other persons, organizations, or entities.
Violation of these obligations may result in the suspension or deletion of the account, removal of content, notification to competent authorities, and is without prejudice to GarageBooks’s right to claim damages.
09User-Generated Content and licenses
You remain the sole holder of the rights in the Content you upload (book photos, descriptions, reviews, messages). By uploading Content to the Platform, you grant GarageBooks a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, modify (for technical adaptations), publish, distribute, and display the Content as necessary to provide, promote, and operate the Service (e.g., previews, SEO indexing, social sharing).
The license has a duration equal to the time the Content remains on the Platform and ends with the removal of the Content itself or with the deletion of the account, except for:
- technically necessary backup copies, retained according to the timelines indicated in the Privacy Policy;
- Content already incorporated into derivative works before removal (e.g., previously published marketing screenshots);
- reviews issued to other Users, which may remain visible in anonymized form.
You are solely responsible for the lawfulness of the Content you upload and declare that you hold the necessary rights to do so.
10GarageBooks Intellectual Property
The “GarageBooks” brand, the logo, the layouts, the source code, the design system, the texts, and the other graphic and functional elements of the Service are the exclusive property of [Ragione Sociale GarageBooks S.r.l.] or of its licensors, and are protected under Italian and international intellectual property law.
Copying, modifying, reproducing, or using them without prior written authorization is prohibited, except for the rights expressly granted to the User in these Terms for the normal use of the Service.
11Reviews
Upon completion of an order, Buyer and Seller may leave each other a review (from 1 to 5 stars and a text comment). Reviews must be based on actual experiences, written honestly, not offensive, not defamatory.
GarageBooks may remove reviews that violate these Terms or the law, but does not intervene on the merits of the assessments expressed. Reviews contribute to the calculation of the User’s public reputation.
12Reports and moderation
Users may report listings or profiles they believe to be in violation of these Terms or of the law, using the dedicated reporting tools on the relevant pages.
GarageBooks will examine reports within reasonable times and adopt appropriate measures, in compliance with the Digital Services Act (Regulation (EU) 2022/2065), including possible removal of content, suspension of the reported User, and transmission of illegal content to competent authorities.
A User whose content has been removed or whose account has been suspended has the right to request a review of the decision by writing to legal@garagebooks.ai.
13Suspension and termination
GarageBooks may suspend or terminate access to the Service at any time, with or without notice, in case of:
- violation of these Terms or the Privacy Policy;
- fraudulent, unlawful, or harmful use to third parties;
- non-payment of amounts due;
- security, technical, or legal reasons.
The User may delete their account at any time from the “Account” section of the profile. The consequences of deletion on personal data are described in the Privacy Policy.
14Warranties and disclaimers
The Service is provided “as is” and “as available”. GarageBooks undertakes to provide the Service with professional diligence, but does not guarantee that:
- the Service will always be uninterrupted, timely, secure, or error-free;
- the AI features will produce accurate results or results suitable for specific purposes (price estimates and cover recognitions are for indicative purposes only);
- Content published by Users is accurate, complete, or free from infringement of third-party rights.
15Limitation of liability
Within the limits permitted by applicable law, GarageBooks shall not be liable for:
- indirect damages, loss of profits, goodwill, data, or business opportunities;
- disputes between Users relating to sales carried out through the marketplace (GarageBooks intervenes only as a mediator within the dispute procedures provided);
- unlawful conduct by third parties, including cyberattacks not attributable to gross negligence of the Service;
- interruptions or malfunctions due to force majeure, third-party services (Supabase, Vercel, Stripe, etc.), or the User’s failings.
To the extent permitted by law, GarageBooks’s total liability towards the User for any cause is limited to the amount actually paid by the User to the Platform in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits GarageBooks’s liability for willful misconduct, gross negligence, personal injury, or in cases of liability that cannot be excluded by law.
16Changes to the Terms
GarageBooks may modify these Terms at any time, for example for regulatory adjustments, Service evolutions, or organizational reasons.
Changes will be communicated by email or in-app notification with at least 30 days’ notice (or a longer period if required by law). Continued use of the Service after the changes take effect constitutes acceptance of them. In case of disagreement, you may delete your account before they take effect.
17Governing law and jurisdiction
These Terms are governed by Italian law. For any dispute arising in connection with these Terms or the use of the Service, the competent court is the Court of [Competent City], Italy, without prejudice to the mandatory consumer forum under Article 66-bis of the Italian Consumer Code when the User acts as a consumer.
18Dispute resolution and ODR platform
For disputes with consumers residing in the European Union, the European Commission provides an online dispute resolution (ODR) platform, available at ec.europa.eu/consumers/odr.
Before resorting to the judicial authority, the User is encouraged to contact GarageBooks at support@garagebooks.ai to attempt an amicable settlement.

If any provision of these Terms is held invalid or ineffective by a competent authority, the remaining provisions shall remain fully valid and effective. GarageBooks’s failure to exercise a right shall not constitute a waiver of that right.
